Legislation

The taking of a Census is governed by the provisions of the Census Act 1951 which allows HM Government of Gibraltar, by order from time to time, to take a Census for Gibraltar.

The legislation to hold the Gibraltar Census on Monday 14 November 2022 is now in place. The details of the 2022 Census are provided in the Census Act (2022 Census) Order 2022 and Census Act (2022 Census) Regulations 2022.

The Census Order

The Census Act (2022 Census) Order 2022 which sets the date of the Census became law on 27th October 2022.

The Census Order is used to direct that a Census is carried out and specifies the following:

  • The date on which the census will take place
  • Persons who need to complete a census questionnaire
  • Particulars to be stated in returns.

The Census Regulations

The Census Act (2022 Census) Regulations 2022was published on the 27th October 2022 and sets out the arrangements that will be made to carry out the census. These include:

  • Enumeration Areas
  • Appointment of persons in connection with the Census
  • Duties of Enumerators, Senior Census Officers and Census Officers.

Is the Census compulsory?

In accordance with the Census Act 1951 and the Census Act (2022 Census) Order 2022 taking part in the Census is compulsory. Persons who refuse to give information or wilfully give false information could be liable, on conviction, to a fine. Some questions are labelled as being voluntary. It is not an offence if you do not answer these.
