The Government has today issued a Technical Notice following the publication in the Gibraltar Gazette of the Immigration (EU Exit) Regulations 2025 and the Immigration (EU Exit) (Amendment) Regulations 2025.

This Technical Notice is aimed at nationals whose rights continue to be protected post-Brexit under the EU Withdrawal Agreement, the EEA EFTA Separation Agreement and the Swiss Citizens’ Rights Agreement. The Government wishes to make it clear that the temporary pause on new residency applications, introduced by the recent Regulations, does not affect the rights of EU, EEA EFTA or Swiss nationals covered by these agreements.

The Notice explains that individuals who enjoy these treaty-based protections retain their existing rights in Gibraltar and these remain unchanged despite the pause in residency applications.

For the majority of the public, this Technical Notice does not apply. Its purpose is solely to clarify the position for those protected groups whose rights are preserved under the above agreements.
